Terms & Conditions

These terms govern access to the XactSight AI website, demonstrations and services. They are written for business users in the United Kingdom.

Last updated: 23 August 2026

XactSight AI is the trading name used for this service. In these terms, “XactSight AI”, “we”, “us” and “our” refer to the provider of this website and service. You can contact us at info@xactsight.ai.

These terms apply when you visit the website, use a demonstration, submit an enquiry or access our AI-assisted evidence and reporting service (together, the “Service”). By using the Service, you agree to these terms. If you use it for an organisation, you confirm that you have authority to bind that organisation.

The Service is intended only for business and professional use by people aged 18 or over. If we agree a separate order form, proposal or services agreement with you, that document will take priority where it conflicts with these website terms.

The Service helps businesses organise video, images, speech and text into draft findings, reports, evidence packs, action lists, scopes and quotes. Features may be provided through the website, WhatsApp or other agreed channels.

Demonstration and early-access features may be incomplete, changed or withdrawn. We do not promise that the Service will always be available, uninterrupted or error-free, but we will use reasonable care and skill when providing paid services.

The Service uses artificial intelligence. AI-generated material can be incomplete, inaccurate or unsuitable for a particular job. It is supplied as a draft for human review, not as a final inspection, diagnosis, certification or decision.

  • You must check source evidence, measurements, calculations, findings and wording.
  • A suitably competent person must approve any safety, compliance, property, pricing or operational decision before it is acted on or shared.
  • The Service is not legal, financial, engineering, surveying, medical or other regulated professional advice and does not replace a site visit or legally required assessment.
  • Do not use the Service to report emergencies or situations needing immediate action.

You remain responsible for how you use, edit, approve and distribute output and for meeting the laws, standards, contracts and professional duties that apply to your work.

You agree to:

  • provide accurate information and keep access links, devices and credentials secure;
  • use the Service only for lawful business purposes;
  • obtain all permissions, notices and consents needed to record people, enter premises and upload or analyse information about clients, workers, residents or other individuals;
  • avoid uploading special-category, highly confidential or unnecessary personal data unless we have expressly agreed appropriate safeguards with you; and
  • keep your own copies of material that your business must retain.

You must not misuse the Service, attempt unauthorised access, introduce malicious code, interfere with other users, reverse engineer protected parts of the Service, evade usage limits, infringe another person’s rights or use output to make an unlawful solely automated decision about an individual.

You keep ownership of material you submit. You grant us a worldwide, non-exclusive licence to host, copy, process, adapt and transmit that material only as needed to operate, secure, support and improve the Service and meet our legal obligations.

You confirm that you have the rights and permissions needed for submitted material and our processing of it. As between you and us, and subject to applicable law and third-party rights, you may use output generated for you for your business purposes. Because AI systems can produce similar material for different users, output may not be unique.

We and our licensors own the Service, website, software, designs, branding, documentation and underlying technology. We give you a limited, revocable, non-transferable right to use them for your internal business purposes while these terms apply. No other rights are transferred to you.

You may give us feedback. If you do, you allow us to use it without restriction or payment, provided we do not identify you publicly without permission.

Website browsing and any feature identified as a free demo are provided without charge. Prices, payment dates, taxes, usage limits, renewal and cancellation terms for paid services will be set out in the applicable order, proposal or checkout process. Unless stated otherwise, business prices exclude VAT.

Each party must protect the other’s confidential information and use it only for providing or receiving the Service, except where disclosure is required by law or to professional advisers and service providers who owe suitable confidentiality duties.

Our Privacy Policy explains how we handle personal data. Where we process personal data on your behalf as a processor, any separately agreed data processing terms will also apply.

The Service relies on third-party infrastructure and services, including hosting, cloud, messaging and AI providers. Their availability can affect the Service. Links to third-party websites are provided for convenience; we do not control or endorse their content or terms.

You may stop using a free feature at any time. We may suspend or restrict access where reasonably necessary to protect the Service or others, investigate suspected misuse, comply with law, address non-payment or respond to a material breach. Where practical, we will give notice and a reasonable opportunity to remedy the issue.

Terms which by their nature should continue—including ownership, confidentiality, limitations of liability and governing law—survive termination.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of terms implied by section 12 of the Sale of Goods Act 1979 or section 2 of the Supply of Goods and Services Act 1982, or any other liability that cannot lawfully be excluded.

Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue, business, contracts, anticipated savings, goodwill or data arising from use of the website, a free demonstration or reliance on unreviewed AI output.

Our total liability arising from free use of the website or a demonstration is limited to £100. Liability for paid services will be governed by the applicable order or services agreement. These limits apply only to the extent permitted by law and do not reduce your duty to mitigate loss.

We may update the Service and these terms. The date at the top shows when they last changed. Material changes will apply from the date stated in a notice or, where no notice is required, when published. Continuing to use the Service after that date means the updated terms apply.

Neither party is liable for delay caused by events reasonably beyond its control. You may not transfer your rights under these terms without our written consent; we may transfer ours as part of a reorganisation, sale or transfer of the Service. A delay in enforcing a right is not a waiver. If a term is unenforceable, the remaining terms continue. These terms do not create a partnership, agency or rights for any third party.

These terms and any non-contractual dispute arising from them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.

Questions about these terms can be sent to info@xactsight.ai.
